The office of Nevada’s Democrat Secretary of State Cisco Aguilar confirmed thatit had received seven voter-related subpoenas from the U.S. Department of Justice over the previous three months. The subpoenas were issued through the FBI. Aguilar’s office said it could not provide further details about the specific records or testimony sought.
The disclosure was first reported by The Nevada Independent on September 3, though the DOJ has not provided a formal comment as of this report.
The subpoenas arrived as Nevada prepared for the November 2026 midterm elections and as the state completed routine voter-list maintenance. Aguilar’s office reported a net decline of 50,130 active registered voters in August, a drop of about 2.4 percent that officials attributed to list-maintenance work that typically occurs before the National Voter Registration Act’s 90-day quiet period.
The requests followed a separate civil lawsuit filed by the Justice Department on December 11, 2025, against Aguilar in his official capacity. In that case, United States v. Aguilar, the department sought Nevada’s complete, unredacted statewide voter registration list, including names, addresses, dates of birth, driver’s license numbers, and partial Social Security numbers.

The department said it needed the records to assess compliance with list-maintenance requirements under the National Voter Registration Act and the Help America Vote Act, and it invoked Title III of the Civil Rights Act of 1960 as the legal basis for demanding the files. Nevada declined to produce the unredacted data, citing state privacy protections.
On August 14, U.S. District Judge Anne Traum dismissed the lawsuit, ruling that the department could not compel production of the sensitive information under the statute it cited. The Justice Department then appealed to the U.S. Court of Appeals for the Ninth Circuit.
Similar requests for voting records have been issued to a number of additional states.
Federal officials have separately raised questions about noncitizens on Nevada’s rolls. Last Month, Homeland Security Secretary Markwayne Mullin reported that an analysis of the public voter file indicated there may be as many as 15,903 noncitizens registered in the state.
Subsequent reporting and internal records indicated that a manual review had confirmed 185 potential cases and that the original number had been described as a ceiling, while another group of roughly 6,200 records was labeled higher-confidence matches still requiring further review. Aguilar has claimed that his office remains open to working with federal agencies to remove ineligible registrants when evidence is provided, though he has pushed back on the current requests.
The specific scope of the seven FBI subpoenas has not been released by either the secretary of state’s office or the Justice Department.
