The U.S. Senate is expected to confirm Jay Clayton as Director of National Intelligence after following a procedural vote on Monday that advanced his nomination by a 51-43 margin along party lines. The confirmation would install Clayton as the permanent head of the Office of the Director of National Intelligence, where he will oversee the nation’s 18 national intelligence agencies.
The expected confirmation comes after President Donald Trump nominated Clayton on June 11, a few weeks after the resignation of former DNI Tulsi Gabbard. “I am pleased to announce the Nomination of very Highly Respected Jay Clayton, former Chairman of the Securities and Exchange Commission, the former Head of Sullivan & Cromwell, one of the most prominent and successful Law Firms anywhere in the World, and the current United States Attorney for the Southern District of New York, to be the next Director of National Intelligence and, importantly, to serve in my Cabinet,” the president said at the time.
“Few people anywhere in the Legal Community are respected at the level of Jay. I encourage the United States Senate to confirm Jay as soon as possible,” he added.
The Senate Intelligence Committee held Clayton’s confirmation hearing on July 15, after an earlier scheduled hearing in June was postponed. On July 21, the committee advanced the nomination by a 9-8 party-line vote.
“Amid a heightened threat environment, having a proven leader in this role is especially important. And Jay Clayton fits the mold,” Senate Majority Leader John Thune (R-SD) said in a statement. Thune further noted that Clayton has “supervised the prosecution of terrorists and the drafting of the indictment against Nicolas Maduro on drug-trafficking and terrorism charges.”
Senate Intelligence Committee Chairman Tom Cotton (R-AR) described Clayton as a nominee with “deep experience combating a wide range of national security threats.”
Clayton has been serving as the United States Attorney for the Southern District of New York. He assumed the role on an interim basis in April 2025 and continued in the position after federal judges in the district approved his continued service in August 2025. In that capacity, his office has handled matters including national security prosecutions, drug trafficking cases, and other federal enforcement priorities in the Manhattan-based district.
A spokesman previously indicated that Clayton would remain in the U.S. attorney role through the confirmation process for the intelligence post.
